Article 2 — Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with Law No. 6502 and the Distance Contracts Regulation, regarding the sale and performance of the product/service (tasting menu, wine tasting, à la carte items, boat package and similar experience reservations) whose characteristics and sale price are set out below and which the BUYER orders electronically through the SELLER's Site.

The type, quantity, date/time, unit price and total price of the ordered product/service are displayed to the BUYER before the order is completed on the Site and are included in the order confirmation sent to the BUYER after the order; this confirmation forms an integral part of this Agreement.

Article 3 — General Provisions

The BUYER acknowledges that they have read and understood the preliminary information on the Site regarding the basic characteristics, sale price, payment method and performance of the product/service subject to the Agreement, and that they have given the required confirmation electronically.

Payment is securely collected via credit/debit card through the virtual POS infrastructure integrated on the Site. Card details are not seen or stored by the SELLER; the transaction is carried out directly through the secure infrastructure of the relevant bank/payment institution.

The service subject to the Agreement is performed on the date and time selected by the BUYER, at the Orfoz Bodrum establishment (or, for products with delivery such as the Boat Package, at the delivery point specified by the BUYER).

The SELLER may postpone the service subject to the order in unforeseeable circumstances such as weather conditions, force majeure, supply issues arising from third parties, or business capacity, provided that the BUYER is informed and an alternative date/time is offered.

Article 4 — Right of Withdrawal

Pursuant to Article 15, paragraph 1(g) of the Distance Contracts Regulation, consumers do not have a right of withdrawal in respect of "contracts for accommodation, transport of goods, car rental, catering, and leisure-time activities for entertainment or recreation purposes, to be performed on a specific date or within a specific period."

Accordingly, the BUYER does not have a statutory right of withdrawal for tasting menu, wine tasting, boat package and similar reservations made for a specific date and time. Nevertheless, in order to avoid inconveniencing the BUYER, the SELLER offers cancellation and refund options within the framework of the rules set out on the "Cancellation, Refund and Withdrawal Policy" page.

Article 5 — Default and its Legal Consequences

Where the BUYER makes payment by bank or financial institution credit card, if the BUYER defaults under the credit card agreement between the BUYER and the bank or financial institution, the card-issuing bank reserves the right to charge interest and collect the debt from the BUYER in accordance with its own applicable legislation.

Article 6 — Competent Court

In the application of this Agreement, the Consumer Arbitration Committees at the BUYER's place of residence, up to the value announced by the Ministry of Trade, and the Consumer Courts at the place of residence of the SELLER or the BUYER, are competent.

Article 7 — Entry into Force

The BUYER is deemed to have accepted all terms of this Agreement upon making payment for their order placed through the Site and/or confirming their reservation request.
